1. About These Terms
These Terms of Use (“Terms”) govern your access to and use of the websites, platforms, software products and related services operated by Mackessy Technology Ltd (trading as MTX), a company registered in Ireland with its principal place of business at Limerick, Ireland (“we”, “us”, “our”, or “MTX”).
By accessing our website at www.mtx.ie, or by using any of our products including AUXION and ClaimLink (collectively, the “Services”), you agree to be bound by these Terms. If you are accessing the Services on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
If you do not agree to these Terms, you must discontinue use of our website and Services immediately.
2. Our Services
Mackessy Technology Ltd provides a suite of connected software platforms designed for the automotive insurance ecosystem, including:
- AUXION – an end-to-end claims management platform for insurers, assessors, and salvage operators, providing features including salvage management, assessor workflows, compliance and audit trails, MI reporting, claims tracking, and real-time case visibility;
- ClaimLink – a digital First Notice of Loss (FNOL) platform enabling customers to report insurance claims via a mobile-first, AI-assisted, no-app-required web experience;
The Services are provided on a business-to-business (B2B) basis to insurers, fleet operators, repair networks, assessors, and other automotive industry organisations. These Terms apply to access via our website and, unless separately agreed by a written contract, to use of our platforms.
3. Accounts and Access
3.1 Platform Access
Access to our software platforms (AUXION, ClaimLink) is governed by a separate written agreement (a Master Services Agreement or equivalent) entered into between Mackessy Technology Ltd and each client organisation. These Terms apply to your use of our public website and any public-facing elements of our Services.
3.2 Account Security
Where you are provided with login credentials to access any platform, you are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must notify us immediately at info@mtx.ie of any unauthorised access to or use of your account.
3.3 Authorised Users
Access to our platforms must only be granted to authorised personnel of the client organisation. You must not share login credentials with any third party not authorised under your agreement with us.
4. Acceptable Use
You agree to use our Services only for lawful purposes and in accordance with these Terms. You must not:
- Use the Services in any way that violates any applicable law or regulation, including Irish law, EU law, or the law of any jurisdiction in which you operate;
- Access or attempt to access systems, data, or accounts that you are not authorised to access;
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive source code from any of our platforms;
- Introduce any virus, malware, ransomware, Trojan horse, or other harmful code into our systems;
- Use the Services to process data in a manner that violates applicable data protection laws, including the General Data Protection Regulation (GDPR) and the Irish Data Protection Act 2018;
- Reproduce, duplicate, copy, sell, or resell any part of the Services without express written permission from us;
- Use automated means to access or scrape the Services without prior written consent;
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
5. Intellectual Property
All intellectual property rights in our websites, platforms, software, content, logos, trademarks, and documentation (including the AUXION and ClaimLink brands) are owned by or licensed to Mackessy Technology Ltd. Nothing in these Terms grants you any ownership rights in our intellectual property.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Services solely for the purposes agreed under your client agreement or, in the case of website visitors, for the purpose of evaluating and engaging with our business.
The MTX, AUXION, and ClaimLink names, logos, and related marks are trademarks of Mackessy Technology Ltd. You may not use our trademarks without our prior written consent.
6. Third-Party Content and Links
Our website and platforms may contain links to or integrations with third-party websites, tools, or services. We do not control these third parties and are not responsible for their content, privacy practices, or terms. Links are provided for convenience only and do not constitute an endorsement.
7. Disclaimer of Warranties
The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Mackessy Technology Ltd disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components. We make no warranty regarding the accuracy or completeness of any information provided through the Services.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under Irish law.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Mackessy Technology Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Services.
Our total liability to you in connection with these Terms, whether in contract, tort (including negligence), or otherwise, shall not exceed the amounts paid or payable by you to us in the twelve (12) months preceding the event giving rise to the claim, or, where no such amounts apply, €100.
This limitation of liability does not affect any rights you may have under applicable Irish consumer protection law where you are accessing the Services as a consumer (though note our Services are primarily directed at business users).
9. Data Protection
The collection and use of personal data in connection with the Services is governed by our Privacy Policy, available at www.mtx.ie/privacy-policy. By using the Services, you acknowledge that we will process personal data in accordance with that policy and applicable law, including the GDPR and the Irish Data Protection Act 2018.
Where Mackessy Technology Ltd processes personal data on behalf of a client organisation as a data processor, the terms of such processing are set out in a Data Processing Agreement (DPA) entered into as part of the client agreement.
10. Regulatory Compliance
Mackessy Technology Ltd (trading as AUXION) is licensed by the Property Services Regulatory Authority in Ireland, Licence No. 004470. Certain activities carried out through our platforms may be subject to applicable insurance regulations, financial services regulations, or other regulatory requirements in the jurisdictions where they are performed. It is your responsibility as a client to ensure your use of our Services complies with all applicable regulations.
11. Termination
We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have breached these Terms or any applicable law. We may also discontinue or modify any aspect of the Services at any time.
Upon termination, all rights and licences granted to you under these Terms will immediately cease. Provisions that by their nature should survive termination will do so, including Sections 5 (Intellectual Property), 7 (Disclaimer of Warranties), 8 (Limitation of Liability), and 13 (Governing Law).
12. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last Updated” date at the top of this document. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
13. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Ireland. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland, without prejudice to any mandatory consumer protection rights you may have under the law of your country of residence.
